STALLION BREEDING CONTRACT This contract is for the breeding service of SUMMER SILVER DRUM, A.P.H.A. #333,739, PtHA #102422. This agreement is between Ed Conway, referred to as PAINT HORSES-R-US, and MARE OWNER;_________________________________________________________who agrees to breed said mare: Mare’s registration name and number:________________________________________________________________ The fee will be $600.00. A $100.00 booking fee will be required as a deposit and will be applied to the breeding fee. ALL FEES ARE NON-REFUNDABLE. Make checks out to Ed Conway. Mare owner is required to supply a copy of mare’s current registration papers. Mare care will be provided at $5.00 per day A veterinary certificate is required stating that the mare has been examined, is breeding sound and free of any diseases or infections that could be transmitted to the stallion. The certificate will only be valid 30 days prior to delivery to the stallion. Mare owner shall authorize and is responsible for payment of any veterinary care required by mare while in care of PAINT HORSES-R-US. Mare must be halter broke and free of hind shoes upon delivery to stallion. Mare owner is responsible for any damage caused by mare to PAINTS R US RANCH. Mare owner shall pay all cost of repairs before mare is released. Live foal is guaranteed. Paint Horses-R-Us live foal guarantee consists of a mare that gets bred and carries a foal full term, and the foal is able to stand and suckle without assistance, and survive for three days. If the foal is born dead or dies within the three day period Paint Horses-R-Us must be notified within 14 days and receive a veterinarian’s statement conforming the death of foal. Then and only then will the mare owner will be entitled to one free breeding the following year only, and with same mare, unless otherwise mutually agreed upon. This guarantee will apply only if the stallion owner is notified within 24 hours of the foal’s birth. If mare loses her foal as stated above, the stallion owner has the option to rebreed the same mare the following year. However if the mare is to be rebreed, a vet certificate of non-sterility and a negative culture are required. If the mare owner fails to deliver mare for rebreeding the following year, then any and all fees paid shall not be refundable and this contract is thereby canceled. If the mare proves not to be in foal in the year bred the mare may be rebred once in same year or in the following year at no cost. Mare is entitled to one free rebreeding, after that breeding fees will be applied to mare. This action cancels out the live foal guarantee. The stallion owner or agent shall assume no liability for a mare that will not breed, cannot conceive, or for accidents, sickness, or death of mare or foal, while in the care of Paint Horses-R-Us. But will exercise every reasonable effort to settle the mare. Will exercise good judgment in the care and supervision of the mare/foal. The mare owner shall not be responsible for injury, accident or death to stallion. The stallion owner reserves the right to refuse any mare. The death or sell of the stallion nullifies this contract. If the stallion becomes ill or injured, the stallion owner or agent has the right to cancel the contract or to postpone breeding services. Breeding fees paid will be refunded. In this event the mare owner has the right to cancel this contract. The death of the mare nullifies this contract. If the mare is sold, the new owner may assume the contract with said mare. Responsibility of payment will be that of the mare’s owner at time of breeding. In the event the mare becomes ill or injured the mare owner reserves the right to postpone breeding. The stallion owner or agent then has the right to cancel this contract. All breeding, board, vet and other fees shall be paid before the mare leaves the premises. Board fees are not refundable. Breeding fees are not refundable except as described above. Booking fees are not refundable. Providing mare owner complies with all terms of this contract Paint Horses-R-Us agrees to execute all documents after the birth of the resulting foal. Mare owner is to notify Paint Horses-R-Us of the birth. Signing of this contract by Mare
owner so deems that the contract has been read, understood,
and agreed to all terms stated within. It is also agreed
that in the event of any legal action resulting of this
contract, Mare owner shall be solely responsible for all
legal fees and cost of Paint Horses-R-Us, its agents, and or
